The environmental fine against Neymar got a lot of media coverage because people accused Neymar of damaging the area around his coastal property, but he doesn’t have to pay a huge environmental fine anymore, as the court tossed out the case against him. After a long legal battle, the court decided the investigation wasn’t solid enough, and the judge pointed out there were serious problems with the evidence and how the whole process was handled, which got people talking about how environmental cases are managed in Brazil and whether the system protects everyone’s rights.

Environmental Fine Against Neymar

What Led to the Fine Against Neymar?

  • Alleged pollution incident: Neymar was accused of dumping construction waste into two bays near Mangaratiba, a coastal town in the state of Rio de Janeiro, which could have an adverse effect on the ecosystem.
  • Fine amount and timeline: Neymar faced a 16 million Brazilian reais ($3 million USD) fine in July 2023, which is a stern penalty under Brazilian environmental laws, which has been suspended since 2024.
  • Basis of evidence: Neymar faced accusations based on photographs and videos submitted anonymously in October 2019.
  • Environmental context: Environmental zones in Brazil, especially in coastal regions like Rio de Janeiro, have strict laws in place regarding environmental crimes, as per the Brazilian Environmental Crimes Law (Law No. 9,605/1998).

Why Did the Court Dismiss the Case?

  • Lack of concrete evidence: The court found that there was no concrete evidence to prove the damage to the environment, as all information used for the investigation was based on visual data.
  • Procedural flaws: The authorities did not carry out a follow-up investigation or collect water samples to prove their claim.
  • Defense technical report: Neymar’s lawyers produced evidence showing water levels were within acceptable environmental standards on the supposed date of pollution.
  • Judicial conclusion: The judge declared the fine “null and void,” stating that all penalties have to be backed by solid evidence and cannot be based on media reports.

How Does This Ruling Impact Neymar and Environmental Enforcement?

The ruling comes at a pivotal time in Neymar’s life as his career continues to be defined by injuries and limited appearances for the national team. After completing his most recent contract with Al Hilal, Neymar signed a one-year contract with Santos FC to rejoin Brazil in 2025 at 34 years of age. If he continues to deal with injuries and a lack of national team appearances following the next World Cup, the question of whether he will retire may become more of a reality than it is now.

The ruling also shows that the environmental fine against Neymar was not able to stand on the merits due in part to poor procedural decisions and almost no legitimate evidence to support the enforcement of the law. Although these laws are of great importance in protecting the environment, enforcement of these laws must be based on credible evidence and open and transparent investigations in order to maintain fairness and integrity in the legal system.
